Absolutely not.
It is illegal!!
And if a Solicitor is charging clients in this way, that Solicitor is breaking the law. Hardly a good start to a legal case!
Section 149 of the Legal Services Regulation Act of 2015 is very clear on this issue. The Act states that:
"A legal practitioner shall not charge any amount in respect of legal costs if..........they are legal costs in connection with contentious business expressed as a specified percentage or proportion of any damages (or other moneys) that may be or become payable to his or her client"
We get asked questions regarding Solicitors taking their fee as a percentage all the time. And our advice is always the same. We cannot, and are prohibited from, charging fees based on a percentage of any damages awarded.
